The PIKE SIX FITNESS Website is a platform through which Shanghai PIKE SIX FITNESS Co., Ltd. (hereinafter referred to as PIKE SIX FITNESS) provide fitness courses and services to users (hereinafter referred to as "you") via the website selection menu for courses. We fully understand the importance of your personal information to you and will do our utmost to ensure its security and reliability. The products and/or services of the PIKE SIX FITNESS Website are intended for adults with full legal capacity. Minors under the age of eighteen should not create an independent PIKE SIX FITNESS account, and those under the age of 14 not to use the products and/or services of the PIKE SIX FITNESS Website. If you are under the age of 14, please do not use or access the PIKE SIX FITNESS Website in any way, nor purchase courses and/or use the services. If you discover that we have inadvertently collected a minor's personal information, please notify us immediately, and we will take steps to delete the relevant data as soon as possible.

I. How We Collect and Use Your Personal Information

We collect and use your personal information in accordance with the principles of legitimacy, legality, and necessity, for the purposes described in this Policy. We will not collect personal information unrelated to providing you with products and/or services, nor will we deny you access to the basic functions of the PIKE SIX FITNESS Website if you do not consent to the collection of your personal information. If we use your personal information for purposes not specified in this Policy, or if we collect or use your personal information for other specific purposes, we will notify you in a reasonable manner and obtain your consent again prior to such collection or use.

(1) We Do Not Collect or Use Your Personal Information for Basic Functions

According to the "Regulations on the Scope of Necessary Personal Information for Common Types of Mobile Internet Applications," the PIKE SIX FITNESS Website falls under the "Fitness and Exercise" category, with "Fitness and Exercise Training" as its basic function. You may use these basic functions without providing any personal information.

(2) Collection and Use of Your Personal Information for Extended Functions

To provide you with a better user experience, we offer the following extended features. When you use these features, we will collect your personal information for specific purposes. We will not collect personal information unrelated to the provision of services. You have the right to choose whether to provide such information; however, in most cases, if you refuse to provide it, we may be unable to provide you with the corresponding services, though this will not affect your use of the aforementioned basic features. Please note: If you provide personal information belonging to someone other than yourself, please ensure you have obtained the consent of the relevant individual.

Please note that the information you provide may involve your own or others' personal information, including sensitive personal information. If such information is disclosed or used unlawfully, it may result in an infringement of your personal dignity or pose a threat to your personal safety or property security. Please carefully consider whether to provide this information to us. We will process such information only with your explicit consent.

1. Helping You Become Our User

1.1 You may choose to register or log in with a PIKE SIX FITNESS member account to use our products and/or services. When you register or log in to the PIKE SIX FITNESS Website, we need to collect your mobile phone number to create or link a PIKE SIX FITNESS account UserID for you, and to help you complete registration.

1.2 To provide you with more personalized and convenient services, you may also log in and use our features with a third-party account (including WeChat accounts). By doing so, you authorize us to access the relevant information you provided when registering on the third-party platform (including WeChat OpenID -- which may include your name and email address) to link it to your PIKE SIX FITNESS account. This allows you to view your class records and related information on the PIKE SIX FITNESS Website for classes booked through the PIKE SIX FITNESS WeChat Mini Program. You may request to disable this feature by contacting us via email as described in Article VII of this Policy. Once disabled, you may no longer be able to view your class history or other information associated with your PIKE SIX FITNESS account User ID on the PIKE SIX FITNESS WeChat Mini Program; however, this will not affect your use of the basic functions of the products and/or services we provide.

1.3 After completing your account registration, you may also choose whether to provide us with your nickname, profile picture, gender, bio, birthday, height, weight, fitness level, and preference information to further enhance your account details. This information is optional for this feature; if you choose not to provide it, it will not affect your ability to log in or register normally.

2. To Provide Transaction Services

When you use the PIKE SIX FITNESS Website to book classes (including in-person group classes), we will collect your class booking information and transaction details (including transaction time and amount). During this process, you may be required to make a payment, and we may collect certain account information. If you refuse to provide this information, you may be unable to book classes; however, this will not affect your ability to use the basic functions of the products and/or services we provide.

3. Providing Class Order Management Services

After you complete a class reservation using the PIKE SIX FITNESS Website, our system will generate an order for your in-person group class purchase. This order will include your check-in information (including check-in time, PIKE SIX FITNESS account UserID, and check-in location), class reservation details, order number, transaction amount, and payment method to help you complete the transaction smoothly and ensure its security. To help you view, inquire about, and manage information regarding ongoing, completed, or canceled orders, we will collect order information generated during your use of our products and/or services and display it to you. You can view and manage your order information via "Me" > "My Orders." If you refuse to provide this information, you may be unable to use the order management feature, but this will not affect your use of the basic functions of our products and/or services.

4. To provide you with personalized content or advertising recommendations

For the features described below; in order to display and recommend more relevant information and services to you, we will track and analyze various types of data -- including your personal information -- through automated or semi-automated processes. Based on this, we will provide you with a personalized user experience and recommend personalized content. At the same time, we will provide you with a convenient way to opt out; you may disable this feature at any time under "Me" > "Settings" > "Privacy Settings," or contact us via the methods specified in Article VII of this Policy.

We will not share your information described above with third-party platforms for personalized recommendations without your separate consent. If you choose not to provide such information, you may not receive more personalized recommendations, but this will not affect your use of the basic functions of the products and/or services we provide.

4.1 Class Recommendations

To provide you with services better tailored to your individual needs, you can create your own personalized fitness profile by editing your information (including your gender, date of birth, height, weight, fitness level, and preferences -- such as exercise habits and fitness goals) to receive more relevant class recommendations. You can modify this information at any time in your profile or disable this feature under "Me" > "Settings" > "Privacy Settings." If you choose not to provide this information, you may not receive personalized class recommendations, but this will not affect your ability to use the basic features of our products and/or services.

5.Providing Security for You

To ensure the security of your account, transactions, and system operations, and to comply with relevant national laws, regulations, and our terms of service, we will, with your authorization, collect your device information while you use our products and/or services. This information includes device model, unique device identifiers (such as MEID, IMEI, MCC/MNC, Android ID, OAID, and BSSID), device MAC address, device serial number, software list, and telecommunications carrier.

To enhance the security of the services we provide, more effectively prevent phishing scams and malware, protect your personal safety and property as well as that of other users or the public, and more accurately identify violations of laws, regulations, or the PIKE SIX FITNESS Website terms of service, we may use or combine your personal information with information obtained from our affiliates and partners -- either with your authorization or as permitted by law -- Based on your usage habits and information about frequently used software, we will comprehensively assess the risks associated with your account and transactions, perform identity verification, and detect and prevent security incidents, while taking necessary recording, auditing, analysis, and disposal measures in accordance with the law.

(I) Sharing
We will not share your personal information with any companies, organizations, or individuals outside of PIKE SIX FITNESS. To provide you with more comprehensive and high-quality products and/or services, certain products and/or services will be provided by our partners. We will share necessary data with business partners through Application Programming Interfaces (APIs), Software Development Kits (SDKs), and other means to fulfill the corresponding services. To provide you with better services, improve our technology, and enhance your user experience, we may share certain personal information with our partners based on your separate consent. We will only share your personal information for lawful, legitimate, necessary, specific, and clearly defined purposes, and will only share the personal information necessary to provide you with products and/or services. (I) Storage of Personal Information

1. Retention Period

We will retain your personal information only for the minimum period necessary to achieve the purposes described in this Policy. For example, after you register as a user, we need to retain your PIKE SIX FITNESS account and UserID to provide you with normal services, respond to your potential inquiries, handle customer service requests and/or complaints, and ensure the security of your account and the system.

Once you actively delete your personal information, deactivate your account, revoke your authorization under this Privacy Policy, or after the necessary retention period has expired, we will delete or anonymize your personal information, except in the following circumstances:

(1) In accordance with relevant laws and regulations, we will retain your relevant personal information for the period required by such laws and regulations. For example, the E-Commerce Law of the People's Republic of China stipulates that information regarding goods and services, as well as transaction information, must be retained for no less than three years from the date of transaction completion. During this retention period, we will cease all processing of your personal information except for storage and the implementation of necessary security measures.

(2) To assist the People's Procuratorate, public security organs, and national security agencies in investigating criminal acts arising from users' use of the PIKE SIX FITNESS Website services, and to better protect users' lives and property, if you are involved in a criminal case while using the PIKE SIX FITNESS services, we will retain your personal information in accordance with the statute of limitations for criminal prosecution as stipulated in the Criminal Law.

(3) If a specific agreement regarding personal information that we have separately entered into with you contains special provisions regarding the retention period for a certain category of personal information, such provisions shall prevail.

(4) Other circumstances where laws, regulations, or normative documents provide otherwise.

2. Geographical Location of Storage

Personal information collected through this Website (including information submitted through the "Join Us" and "Career" sections) is stored on servers located in the United States.
Certain services available through this Website, including class booking, are provided through third-party booking platforms operated by our local affiliates or business partners in different countries or regions. Where you choose to access those booking services, your personal information will be collected and processed by the relevant local entity in accordance with its own privacy policy and applicable local laws.
Where required by applicable law, we will implement appropriate safeguards for any cross-border transfer of personal information.

3. Termination of Operations

If we cease operations of a particular product and/or service, we will notify you at least 30 days in advance via individual delivery or public announcement, promptly cease further collection of your personal information, and delete or anonymize the personal information we hold that is related to the discontinued business. Where minor's personal information is involved, we will also promptly notify the minor's guardians of the termination of operations.

To provide you with better products and/or services, our business may change from time to time. As we continuously strive to improve our technology, we may introduce new or optimized features from time to time, and this Policy will be adjusted accordingly. We will not reduce the rights you are entitled to under this Policy without your explicit consent. We will notify you of updates by posting an updated version on the PIKE SIX FITNESS Website or through PIKE SIX FITNESS official business WeChat account. VIII. Supplementary Provisions

This Policy shall be interpreted and governed in accordance with the laws of the People's Republic of China.

If any court of competent jurisdiction rules or adjudicates that any provision of this Policy is invalid, such provision shall be removed from this Policy; however, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy. The remaining provisions of this Policy shall remain in full force and effect.

The headings in this Policy are provided for convenience only and do not affect the meaning or interpretation of any provision of this Policy.

PIKE SIX FITNESS operates under rules and regulations established to ensure the safety and protection of its members. The terms and conditions govern rights and obligations of PIKE SIX FITNESS and members thereof. Please carefully read and understand all the terms and conditions stated herein.

In accordance with the actual operation of the venue, the venue shall be entitled to inform members of adjusted contents of professional services in advance, and shall make promulgation in time. The latest announcement of the official account (WeChat ID: pikesixfitness) shall prevail, and final interpretation of the announcement shall be reserved by PIKE SIX FITNESS.

1. MEMBERS MEMBERSHIP

Membership is available to individuals who have attained a minimum age of 14. Participants over the age of 14 but under the age of 18 must be accompanied by their guardian to participate in the classes. For children under 14 years old, if they enter the venue, at least one guardian must be accompanied to monitor. All losses or injuries caused by non-compliance with the provisions thereof shall be borne by the guardian, and PIKE SIX FITNESS will not bear any legal liability.

A Members may be entitled to transfer their membership and the remaining prepaid balance to a third party, subject to the payment of an applicable processing fee. A member may not loan or sell his/her membership or otherwise permit it to be used by ant third party. Except for the following cases, for example: business trip, vacation, etc. Members can choose to extend their membership for one month and pay an extension fee of RMB 100.

Memberships are currently valid only at the studio where membership packs were purchased. For questions relating to this please consult your home studio for support when travelling or visiting another location.

You acknowledge and agree to the following:

In regards to members class pack, terms are set out below.

1.1 The class pack is activated when for the first class is reserved by members in the online booking system. “Card validity period” shall start from the activation. After purchasing the class pack, members need to activate class pack within 2 months from the date of purchase, and overdue class packs shall be deemed as invalid.

1.2 After expiration of the validity period of class pack, members can continue the same service or choose other card types (except for the condition that time-limited special card cannot be continued). (For group class, the group class pack shall be continued, and for private class, the private class pack shall be continued) After receiving the corresponding payment, the venue can complete procedures of card renewal, offer new card and renew the Agreement.

1.3 For refund after members purchase class pack, if the pack / membership is not activated, fees will be refunded in full within 30 days, but if the pack / membership has been activated for 7 to 30 days, member can only receive the refund after paying 30% of the total payment. If the pack / membership is activated, member can only receive the refund after paying 30% of the remaining value of the package/membership. For services and cards purchased on the third-party platform, it is required to contact the purchaser directly, and the venue cannot process any refund.

1.4 If it is necessary to temporarily freeze class packs due to illness or physical injury, relevant medical proof must be presented, and the venue will reasonably arrange to freeze the membership according to the specific situation. Members can enjoy the service of one free extension, provided relevant documents of proof from hospitals are submitted in special circumstances such as injury or pregnancy. For specified class packs, members may extend their validity by paying an extension fee of RMB 100 for an additional month.

1.5 Members shall apply to the customer service of PIKE SIX FITNESS Venue at least 1 month prior to the expiration of membership, and in case of failure to submit application for extension within the time limit, it shall be deemed that the members automatically waive the right. If you wish to transfer your classes, there is a fee of 200, to be paid by the transferor.

1.6 After expiration of the validity period of class pack, members can continue the same service or choose other card types (except for the condition that time-limited special card cannot be continued). (For group class, the group class pack shall be continued, and for private class, the private class pack shall be continued) After receiving the corresponding payment, the venue can complete procedures of card renewal, offer new card and renew the Agreement.

1.7 All First-Time Specials are used once for a single person. Members are entitled to one-time use and cannot purchase and use the Special again

1.8 To cancel membership, please contact your home studio directly. Our team will assist you according to your membership agreement.

2. PHYSICAL CONDITION

Members need to ensure that they are in good health, have no major illnesses or diseases, suitable for all kinds of activities in the gym or the use of the gym's sports facilities.

Members acknowledge that the studio is a supervised fitness studio, and you hereby agree to carry out exercises responsibly with due care and attention to your own medical/mental condition at all times.

In case a member suffers from any of the above diseases or conceals his/her medical history while at the venue for exercise, the venue shall be entitled to terminate his or her membership and reserve the right to investigate legal responsibility. All injuries and consequences caused by members illness during sports rather than reasons of the venue shall be borne by the members themselves.

Prenatal and postnatal training options area available, however we recommend obtaining clearance from your healthcare provider before participating in any training during pregnancy.

3. PRIVACY

You consent to the studio disclosing some or all of the personal data that we collect from you for purposes related to registration and maintenance of your membership with us and the provision of the studio's services to you including the enforcement of the membership policy agreement in accordance with the privacy policy.

You consent to receive special offers, marketing/advertising communications from PIKE SIX FITNESS through email address and telephone numbers.

You grant permission and right to publish, copyright and use pictures and audiovisuals of yourself in which you may be included in whole or in part for the marketing usages of PIKE SIX FITNESS. If the Member objects to the use of their likeness in a specific context, they must proactively notify PIKE SIX staff before any recording takes place in writing and submit a formal opt-out declaration. Failure to provide prior written notice in advance shall be deemed as consent to such use.

4. SAFETY NOTICES

You acknowledge the followings:

4.1 members must wear civilized clothes, that is, they must wear corresponding sports clothes during exercises, and it is not recommended to wear jewelry. If member wears clothes that are inappropriate for exercising and refuses to change after communication, the venue shall be entitled to terminate his or her current class, and deduct the class or validity period according to relevant regulations.

4.2 members are not allowed to train without the guidance of the venue trainer during non-class periods. During the class, members need to operate the equipment according to the trainer's instruction. If a member trains on his/her own during non-class period or refuses to follow the instructor's instructions during class, resulting in injuries to himself/herself, he/she shall be responsible; if he/she causes other people’s injuries or damages to venue equipment, he/she shall bear the full responsibility for the compensation, and the venue shall not bear any responsibility.

4.3 Members are responsible for their personal cash, computers, mobile phones, jewelries as well as other valuables. The venue will not be responsible for any loss or damage. Public lockers are used to place clothes and other daily items, and it is not recommended to store valuables, and storing inflammables, explosives, as well as other dangerous and illegal goods in the lockers is prohibited. Once the above-mentioned dangerous and illegal goods are found, the venue shall be entitled to dispose of the goods and investigate relevant responsibilities of members. Since public lockers are for public temporary use, members must take their personal belongings and empty the lockers when leaving the venue. The venue shall be not responsible for any items left or lost in the public dressing room, and will not assume any responsibility for safekeeping.

5. LIMITATION OF LIABILILITY

Members agree that the studio and any other PIKE SIX FITNESS facilities that you visit will not be liable to you, to the extent permitted by law, for an injuries, disability, death, or loss or damage to person or property that you may have suffered, except from results of gross negligence or breach of agreement.

In the event that any PIKE SIX FITNESS facility is found by law to be liable to you, you agree that the total damage payable to you (if any) shall not exceed the total membership fees payable by you during the initial Minimum Term (regardless of any extension of the membership and/or Minimum Term thereafter).

In case the venue cannot be continuously operated due to changes in government laws, wars, strikes, natural disasters, epidemic and other force majeure after the official operation, it will not bear any legal liability or repay any amount of remaining unused part.

6. Prohibited Acts

You must not do the following:

6.1 Members engage in commercial activities and business operations without the written consent of PIKE SIX FITNESS. The venue shall be entitled to ask members leave the venue and terminate the Agreement, where all legal liabilities shall be borne by members

6.2 cause any damage to venue facilities and goods, otherwise compensate according to the market price.

6.3 Violate the dress cold set by the facility

6.4 Bringing dangerous materials such as blades, and other items that may hurt users or staffs in the studio.

6.5 Touching other members, clubs, property, etc. without justifiable reason

6.6 Participating in class while intoxicated

6.7 Other acts that the PIKE SIX FITNESS headquarter, affiliated venues, studios reasonably judge to be inappropriate for the normal operation of the studio.

7. DISPUTE RESOLUTION

If there is any dispute between the venue and the members, it shall be solved by friendly negotiation. If negotiation fails, the dispute shall be submitted to the People's Court of Jing'an District, Shanghai for litigation.

8. CLASS/ATTENDANCE RULES

General Rules

8.1 Regular group classes require a specific number of bookings for the class to take place, otherwise the venue shall be entitled to cancel, under which case, the venue will notify members to cancel or change class by WeChat, telephone or SMS when contacted the members 90 minutes prior to the class.

8.2 The schedule of regular group classes shall be updated every two weeks, and shall be published on the official account of the venue. All classes can only be booked through reservation system listed in the official account (WeChat ID: pikesixfitness), and no booking through WeChat group, WeChat message or leaving messages on public account can be accepted. To ensure best health and training results of members, up to two classes can be booked per day for all types of cards.

8.3 To ensure safety of members and avoid interruption the class, the classrooms will be closed 5 minutes after class commencement, and late members late will not be let into the class. For all special classes, classrooms will be closed after class commencement. Once members are late, he/she will not be able to attend the class and the class will be deducted from the class pack.

8.4 To ensure class quality and avoid disruption, non-scheduled members are not allowed to attend the classes, except those designated by the venue trainers and staff.

8.5 Class bookings close 90 minutes before the scheduled start time. For late bookings, please contact your studio directly. Please note, policies may vary by location, so it is recommended to consult your local studio for accurate information.

8.6 First-time clients should arrive 15 minutes early for check-in and orientation. Returning members should arrive at least 5 minutes before class starts.

Cancellation policy

8.7 cancellations must be made at least 6 hours before group classes, and 3 hours before private training classes.

8.8 Late cancellations or no-shows will result in the session being deducted from your package or membership.

8.9 Membership service holders shall enjoy corresponding exemption cancellation according to the latest membership service content released by the venue. In case of failure to cancel in the above way, one class will be directly deducted from the class pack.

9. TERMINATION

Under any of the following circumstances of members, the venue shall be entitled to terminate the Agreement immediately without refunding any fees or making any compensation:

9.1 Personal behavior of a member that seriously affects other members, such as using mobile phones during class, and the member still refuses to change after communication

9.2 Any intentional verbal or physical attacks on others, fights, infringes on others’ privacy, conducts other acts that violate laws or infringe on others interests

9.3 Behaviors that affect the normal operation of the venue

9.4 Repeated violation of operation regulations and rules of the venue

9.5 Other acts that the PIKE SIX FITNESS headquarter, affiliated venues, studios reasonably judge to be inappropriate for the normal operation of the studio.

10. GOVERNING LAW AND JURISDICTION

10.1 This agreement shall be governed by the legislation law of the People's Republic of China.

10.2 The terms and conditions are expressed in both English and Chinese versions; if there is any inconsistency between the English and Chinese versions, the Chinese version shall prevail.
